Contract for Purchasing an English Bulldog

Legends of Denmark English Bulldogs
Buyer/Owner's Name: ____________________________
Date reserved:__________________________
Price:______________ Sex of Animal: _________

Puppy’s Nickname________________________________

We, the seller, agree to warranty this puppy for 365 days from the date of reservation from any life threatening illness that is genetically related. We, the sellers, will replace the defective puppy with a puppy of comparable quality, as determined by the seller, as soon as a comparable puppy becomes available. Full medical documentation must precede the return of the defective animal. The documentation must explicitly and singularly identify that the cause of the puppy's defect is genetically related and that it is detrimental to the puppy’s long term health, in other words life threatening. The results of this documentation are to be evaluated by a veterinarian of the seller's choosing to confirm and authenticate the results provided by the buyer's veterinarian. The findings and opinions of the seller's veterinarian are to be considered the final and ultimate opinion. All transportation expenses involved in the return of the original puppy as well as the replacement puppy are the responsibility of the buyer. We, the seller, do not agree to compensate the buyer for any veterinarian expenses.

We, the sellers, offer the buyer the opportunity to have the puppy inspected by a veterinarian of the buyer's choice within 72 hours of the arrival of the puppy. If a genetic condition is found that is life threatening the buyer may return the puppy for a puppy of comparable quality, when a comparable puppy becomes available, as determined by the seller. The buyer must make the seller aware of this discovery within one (1) week of the date that the buyer receives the puppy. The replacement puppy will be delivered to the buyer only after the defective puppy has been returned, and as soon as a comparable puppy becomes available. All transportation expenses related to the original puppy as well as the replacement puppy are the responsibility of the buyer. The seller does not extend this policy related to common or insignificant or short term conditions. These include, but are not limited to, the presence of common parasites (demodex, round-worms, coccidia, Giardia, hookworms, etc.), fleas, entropian, cherry eye, small scratches, scrapes or bites from other puppies or coughs that are deemed to be short-term by the veterinarian of the buyers choosing. The opinion of the buyer's vet, during the initial examination is to be considered final regarding non-genetic illnesses and cannot jeopardize the seller if the puppy is misdiagnosed by the buyer's veterinarian regarding diagnosis or prognosis of the condition. All veterinarian expenses resulting from this inspection are the responsibility of the buyer.

The buyer has five days upon the discovery and notification to the seller of the above mentioned life threatening condition to return the puppy to the seller. Failure to return the puppy to seller within five days is construed to reflect that the buyer is satisfied with the puppy's health and absolves the seller from any and all responsibility from that day forward.

Our warranty does not cover hips. There are a few reasons that we exclude hips from our coverage.

1) Because of the angularity and frame structure of Bulldogs, a person could make the case that every bulldog (in theory) is dysplastic to a degree. Much of what could be clinically classified as Dysplasia via X-ray, has no negative impact on the dog in terms of discomfort or physical limitations and is a result of breed characteristics that are specified in breed standards.

2) There are factors other than genetics that contribute to Dysplasia. Including, but not limited to, the slope that a dogs lives on, the floor surface, the activities the dog participates in.

In the event of sudden death of a puppy that we sell within the first year, due to genetically related circumstances, we agree to replace the puppy with a puppy of comparable quality, as determined by the seller, as soon as a comparable puppy becomes available after the seller receives a certificate of death issued from a licensed veterinarian. The certificate of death must say explicitly that the cause of death was related to an identified genetic condition through a proper autopsy. The results of this certificate are to be evaluated by a veterinarian of the seller's choosing to confirm and authenticate the results. The findings and opinions of the seller's veterinarian are to be considered the final and ultimate opinion. All post-mortem procedures performed on the deceased puppy are the responsibility of the buyer. All transportation expenses related to the replacement puppy are the responsibility of the buyer.  We, the sellers do not agree to extend this policy to puppies that die in a non-sudden manner, related to a genetic condition. (I.e. from a condition that the buyer had become aware of previously but elected not to return the puppy to the breeder for a comparable replacement within the specified period of time).

Although a conscious effort is made by the seller to breed and produce sound, healthy bulldogs, buyer should understand that due to the nature of this breed, bulldogs are predisposed to certain medical abnormalities and that a normal bulldog may have one or two of these conditions during its lifetime.  The buyer is urged to research the breed and be familiar with all the health issues that could affect their bulldog before entering into this or any agreement to purchase a bulldog.  It is also very important to have a veterinarian knowledgeable about the bulldog breed to use as your vet.

The deposit amount of $500 and any fees assessed are non-refundable and non-transferable if the buyer defaults on the purchase of the puppy.  If the buyer pays for the puppy in full, $500 of the payment and any fee’s ( fees may include but not be limited to health certificates, gas, travel crates, additional medical care for puppy after date of sale) will be forfeited. The deposit and/or a tracking and money order number as well as a faxed or emailed signed copy of this contract must be received by the seller within 24 hours or the puppy may be taken off hold at the seller’s discretion.

**All deposits are final and non-refundable or transferable. Please note that there is a 3.5% handling fee for all payments made through PayPal. Minimum deposit is $500.00.

The balance of the purchase price is to be received by the seller at least seven days prior to the puppy being delivered. The signed original contract is to be received within seven days of reservation of the puppy, (buyer must email a signed copy of the contract to seller within 24 hours of reservation of the puppy), or the seller may offer this puppy to other interested parties. In which case the buyer forfeits their deposit and any fees assessed.

All puppies are sold under limited registration through the AKC.  If a puppy is a show prospect and the buyer wishes the show a puppy, the seller will remain on the AKC paper work as a co-owner until the puppy has finished his or her championship.  Once the championship has been awarded the seller will release full ownership to the buyer.

I the buyer agree to provide the seller with pictures of the puppy that I am purchasing.

If it is found that I have in any way abused or neglected this animal either knowingly or unknowingly through physical violence, neglect, or lack of medical attention or any other number of ways abuse may be determined then I acknowledge that I have violated this contract and I agree that the dog automatically reverts ownership back to the seller and I will pay any and all legal costs and any and all fees that will be accrued by the breeder in their attempt to regain custody of the animal.  This includes but is not limited to any monies necessary to have the dog shipped back to the seller.

I the Buyer also agree to keep all vaccinations & wormings current, including rabies and Parvo. Buyer will provide regular heartworm and flea and tick preventative as prescribed by your veterinarian.  The puppy will have an annual visit to your Vet to be tested for heartworms every year of its life. I agree to provide proof of medical care for the puppy to the seller at anytime asked at buyer’s expense.

If the puppy develops any ailment I will contact the seller to make them aware of the condition.  I understand that there are conditions that although not life threatening but common to the bully breeds, need to be known by the breeder so that the breeder can continue to breed the healthiest dogs possible.

BUYER INITIAL ___________

I the buyer agree that if for ANY reason I cannot or do not want to keep this animal that I will first contact the seller. The seller will have first option on the return of the animal at the buyer’s expense. I cannot “sell” the dog back to the seller at a profit.  The seller will not pay more than the original purchase price for the dog, and may take depreciation if the dog is older and will not be able to place the dog in a new home for the amount originally paid. The seller will be given a minimum of 90 days to pay the buyer. If I am returning the dog because I have violated this agreement ownership automatically reverts back to the seller and they will not be responsible to pay any monies for the return of the animal, including but not limited to the original sale price and fees if any.  The seller will have final approval of placement of the animal. I agree to give the seller access to the potential new owners in order to interview and approve or decline the new placement of the animal. I will abide by the sellers opinion, seller’s approval will be final.  I will also get a modified contract from the seller to have signed by the new owner so that the seller will continue to receive pictures of the dog and to continue to protect the dog against misuse as far as breeding the animal in an unacceptable way that does not coincide with the seller’s original contract with me. I will provide the original of this contract to the seller immediately once the new owner is approved.  I will not under any circumstances place or sell the animal to a shelter, pound, animal control facility, humane society, pet store, or with any known breeder or person(s) that I know have intentions of breeding the animal, or any other like establishment without written approval from the  breeder. Should I fail to abide by these conditions I agree that the dog automatically reverts ownership back to the seller and I will pay any and all legal costs and any and all fees that will be accrued by the breeder in their attempt to regain custody of the animal.  This includes but is not limited to any monies necessary to have the dog shipped back to the seller.

I agree to register the name of the puppy using the prefix “Legends of Denmark” before whatever name I select for the puppy.

BUYER INITIAL ___________

I attest that I am at least 18 years of age and that this is to be considered a legal and binding contract between me the buyer and the seller.

I agree to mail and/or email the signed and dated contract to the seller with the balance of the purchase price as stated previously in this contract.  I understand that no animal will be shipped until the signed original of this contract has been received by the seller.  I understand that if the seller does not receive this contract within seven days of the reservation of the puppy that I will forfeit any monies paid and the seller may offer the animal for sale to other interested parties.

By copying, pasting and emailing this warranty, I reflect that I agree and am legally bound to all of the terms and conditions stated above.
